Abstract

The military judiciary is part of the Special Court, which has special procedures for determining and regulating the military justice organs and their respective powers. Unlike ordinary criminal courts, the military judiciary is directed at military personnel and individuals subject to military laws and regulations as well as the Tribunal's bench of justice judges and military officers. The wording of the judgments, as well as the mechanism for issuing them, emphasize the uniqueness of the Military Justice Act. It has also a single level of litigation, which necessitates the expeditious implementation of investigation and sentencing due to the fact that crimes within his jurisdiction and the competence of military justice have an impact on internal and national security and public order. Even if they are not mentioned in the text, a suspect or accused person has certain guarantees of his or her rights, such as the right to defense, the right to seek medical expertise, and the right to remain silent, as well as the safeguards associated with military court trials, such as prima facie and public. In this regard, we will discuss the guarantees granted to the accused before military courts during the investigation and trial stages in light of the Military Justice Act No. 24/68 and the current Code of Criminal Procedure
